Your Excellency,
I write to you to urge the Security Council to support the UN Human Rights Council-mandated independent international fact-finding mission which will investigate human rights abuses in the 22-day Israel-Gaza conflict in December 2008 and January 2009. I call on you to ensure that the Council demands the cooperation of both the Israeli and Palestinian sides with the fact-finding mission.

As you know, both the newly appointed Chair of the fact-finding mission and the President of the Human Rights Council have acknowledged that the mission can only credibly fulfill its mandate by also examining the violations of international law committed by Palestinian armed groups, thereby allaying concerns that the investigation excluded Palestinian abuses.

In the course of its investigations in southern Israel and the Gaza Strip Amnesty International found that serious violations of international humanitarian law, including war crimes, were committed.

The victims deserve to know the truth and obtain justice. The first step towards achieving this is an authoritative, independent and comprehensive investigation.

Furthermore, I call on you to ensure that the Council request of the UN Secretary-General to receive the report of the UN Board of Inquiry investigating attacks on UN personnel and facilities in Gaza, and to make public the findings and recommendations of the report.

08年12月から09年1月の22日間に、イスラエル・ガザ紛争下で起きた人権侵害を調べるために国連人権理事会が任命した独立の国際事実調査団を、安全保障理事会が支持するよう要請します。また、イスラエルおよびパレスチナ双方が事実調査団に協力することを安保理が保障するよう要請します。

パレスチナ武装勢力による国際法違反も調査することによってのみ、同武装勢力による人権侵害の調査が除外されるという懸念を和らげることができ、その任務が信頼され、十分に果たすことができると、調査団長と人権理事会議長はともに認めています。イスラエル南部とガザ地区を調査する過程で、アムネスティ・インターナショナルは戦争犯罪をはじめとする数々の国際人道法違反があったことを確認しています。

真実を知り、正義がもたらされる権利が被害者にはあります。そのための第一歩が、権威ある、独立した、かつ徹底的な調査なのです。

さらに、ガザにおける国連の職員と同施設への攻撃について調べている調査委員会の報告書を安保理が受けとり、報告書の所見と勧告を公表することを保証するよう国連事務総長に要請するよう、安保理議長に要請します。
