ジャミラ・アブ・サバさんと夫のモハメド・アブ・サバさんと子ども6人の家族は、被占領パレスチナ地域であるヨルダン川西岸地区南部のマサファー・ヤッタに暮らす。この地域には180軒ほどのパレスチナ人家族が住むが、いずれも強制退去の危機にさらされている。現在、およそ1,150人のパレスチナ人（その半数は子ども）が、全面的取り壊しが予定されている9つの村に住んでいる。23年にわたる裁判の末、イスラエルの最高裁は5月4日、同地域住民の立ち退きを進めることを認める裁定を下した。この裁定以降、当該地域でのイスラエル軍の活動は活発化し、取り壊しへの不安が広がっている。イスラエルによるパレスチナ人の排除は、戦争犯罪と人道に対する罪にあたる強制移送に相当する。
マサファー・ヤッタは19の村からなるが、そのうち9つの村が取り壊しの危機にある。住宅、畜舎、貯水池、小中学校、地域インフラのほぼすべてが、軍事地域指定エリア内に無許可で作られたというのが、取り壊しの理由だ。実際のところは、パレスチ人に対する差別的な土地・住宅制度の中で、パレスチナ人が建設許可を得ることはほぼ不可能だった。
最高裁が取り壊しを認める裁定を下したため、サバさん宅は、5月11日と6月1日の2回、イスラエル軍による取り壊しを受けた。9月には、子どもたちが通う学校の隣で軍の戦車演習が実施された。妻ジャミラさんはチーズ製造を営むが、仕事場をテント一張りに収めるための対応をしなければならなかった。200頭の羊を飼い、世話をしている夫モハメドさんは、テントの取り壊しに備えて、家族を収容できるように、以前、羊を飼う場所として使っていた洞窟に手を加え、家具を備えつけた。
11月23日、小学校がブルドーザーで取り壊された。昨年6月には、村と村をつなぐ道路と水道管が破壊された。その後水道管は修復されたが、再び破壊されるおそれがある。住民は10月14日、アムネスティに対して、軍の検問所を超えることができず、教師が勤務する学校に行くことができなくなることがあると語った。7月15日には、病気の治療に向かう男性（62歳）が検問所で10時間、足止めされた。住民や教師は、車で移動時に立ち入り禁止区域に入ったという理由で何度もイスラエル軍に車を没収されてきた。
マサファー・ヤッタの村々は、被占領西岸地区のエリアCにある南ヘブロン丘陵に位置する。エリアCはイスラエル当局が土地の使用について排他的な支配を行っている地域で、西岸地区の６割を占める。国連人道問題調整事務所によると2018年から2022年にかけて、エリアCでの差別的な区画整理で、西岸地区のパレスチナ住民4,323人が強制退去させられ、約3,500棟が取り壊された。その他にも5,000人超が強制退去を受けるおそれがある。同時に、イスラエル当局はユダヤ系イスラエル人が東エルサレムを除く西岸地区の約4割にある279カ所の違法入植地への移住を奨励するために、補助金、税制優遇措置、低コストの公共料金を提供してきた。その結果、イスラエルの団体ピース・ナウによると、現在465,400人超のイスラエル人入植者が居住している。また、2018年から2022年の間で、10,294戸のイスラエル人住宅建設計画が承認されたが、パレスチナ人住宅で建設が承認されたのは、わずか27戸に留まっているとのことだ。

Dear Brigadier General Fares Atila,
I am concerned about the forced displacement of Jamila and Muhammad Abu Sabha, their family, and other Palestinian villagers in the south of the West Bank in the Occupied Palestinian Territories (OPT). Nine villages in the area, known as Masafer Yatta, are at imminent risk of demolitions and their 1,150 inhabitants face forced displacement.
The Israeli army said that it needed to conduct training in the area, and so declared it a “firing zone”. The villagers appealed against this plan, because they have lived in Masafer Yatta for generations, and they need the space for raising livestock. However, the villagers have now exhausted their legal remedies since the Supreme Court rejected their request for a further hearing on 2 October. The demolition of homes, schools and roads is a violation of Masafer Yatta villagers’ right to an adequate standard of living, including housing, under international human rights law.
In the region of Masafer Yatta, meanwhile, several Israeli settlements and outposts are expanding: Mitzpe Yair to the south, East Susya to the west, Avigayil, Havat Maon and Maon to the north. The settling of an occupying state’s civilians in occupied territory and the forcible transfer of protected persons are serious violations of international humanitarian law and war crimes. These forcible transfers are carried out to maintain Israel’s system of oppression and domination over Palestinians, and therefore also constitute the crime against humanity of apartheid.
I call on you to immediately halt all plans to demolish Palestinian homes and evict residents in Masafer Yatta, end Israeli settlement activity, and to stop forcible transfers of the Palestinian population in the occupied West Bank in general. Israel should also end other violations against Palestinians in the OPT, such as arbitrary restrictions on Palestinians’ freedom of movement and residence in their communities, and on their rights to access livelihoods, healthcare services and education.
