ジャヴェド・アスラムさんは20年にわたり、ギリシャのパキスタン人団体の代表を務め、移民の権利や労働者の権利などを擁護してきた著名な活動家だ。彼の在留資格をはく奪しようとしてきたギリシャ当局は、2026年3月、ジャヴェドさんの難民認定を取り消した。この決定は、彼の人権活動や地域社会への貢献を標的としたものと見られる。取り消し決定では、ジャヴェドさんがパキスタンでもう危険にさらされることはないという根拠は示されず、ギリシャで長年、生活を築いてきたという事実も考慮されていない。ギリシャ当局は、彼の難民認定を回復し、強制送還手続きを中止しなければならない。
ジャヴェドさんは長年パキスタン当局から標的にされてきた。2007年には不法移民や人身売買の関与が疑われるとして彼を指名手配し、ギリシャ当局に身柄引き渡しを求めた。ギリシャ諜報機関の工作員に拉致されたと主張するギリシャ在住の6人のパキスタン人の支援に関わったためだと考えられる。この時アムネスティは、彼が帰国した場合、深刻な人権侵害を受ける現実的なおそれがあるとして、身柄引き渡しに反対した。
その後も、パキスタン当局は彼を指名手配犯扱いし続けた。ジャヴェドさんは2019年にギリシャで難民申請し、2020年に一旦は却下されたものの、異議申し立てを経て2021年に認められた。しかしギリシャ当局は2021年と2023年に彼の難民認定を取り消そうとし、2026年3月、とうとう認定が取り消されてしまった。パキスタンにおける彼の状況が変化し、国際的な保護が必要でなくなった、というのが理由だ。この決定には、送還命令が伴う。
認定取り消し決定は、ギリシャがパキスタンを引き続き「安全な出身国」と指定していること、および当局がパキスタンの人権状況や司法制度に進展があると見なしていることに基づいている。また、ジャヴェドさんが「指名手配状態」にあるという証拠はない、という主張もあった。
しかし、ジャヴェドさんの難民認定の根拠となった状況が実質的に変化した、あるいはパキスタンに送還された場合に刑事訴追やその他の不利益な状況に陥らないことは、示せていない。彼が人権活動のためにギリシャ国内でパキスタン当局から長年標的にされてきたという事実も考慮されていない。パキスタンでは、人権活動家が弾圧される懸念が続いている。
たとえギリシャがジャヴェドさんの難民としての地位を終了させる決定を下したとしても、人権侵害の現実的なリスクがある国への送還を禁じる「ノンルフールマン原則」に基づく義務を免れるものではない。
ジャヴェドさんは、30年近くにわたりギリシャで生活を築いてきた。妻と娘は、いずれもギリシャの合法的な居住者である。難民資格を取り消すという決定は、彼の家庭生活に対する権利も損なうものだ。

Dear Minister Plevris,
I am writing to express serious concern regarding the cessation of refugee status of human rights defender Javed Aslam, President of the Pakistani Community of Greece.
Javed Aslam has lived in Greece for nearly 30 years and is a well-known human rights defender, advocating for migrant and labour rights. He has established strong community and family ties in Greece. Since 2007, he has faced targeting by Pakistani authorities. Greek authorities have, in several instances, sought to end his status, placing him at risk of return to Pakistan. Despite this, Javed Aslam was ultimately recognized as a refugee in Greece in 2021.
In March 2026, his protection status was terminated, as Greek authorities argued that that the circumstances in Pakistan had changed for him, and he no longer required protection. Javed Aslam’s case comes amid a broader escalation in Greece’s increasingly hostile migration policies, following your Ministry’s stated intention to terminate large numbers of protection decisions.
I am concerned that the decision to end Javed Aslam’s refugee status seems to target his legitimate human rights and community work in Greece. Greek authorities have failed to demonstrate that his protection needs have ceased, particularly given the long-standing targeting he has faced at the hands of the Pakistani authorities. The decision also fails to consider ongoing human rights concerns in Pakistan, especially for human rights defenders. In addition, the measure would also uproot Javed Aslam from this political activism and would interfere with his family life, affecting his rights.
We therefore urge you to restore his international protection status or grant him an alternative secure status and immediately halt any deportation proceedings.
