イスラエルの占領下にあるヨルダン川西岸地区のパレスチナ人の村ザヌータでは、住民約250人（うち約100人が子ども）が入植者による暴力のために村を追われ、2023年10月以来、避難生活を余儀なくされている。イスラエル警察と軍は、国際法上の義務とイスラエル最高裁判所の2件の判決に反し、住民が安全に帰還できるようにせず、入植者による暴力からも保護してこなかった。イスラエル当局は直ちに、ザヌータのパレスチナ人住民が迅速かつ安全に村に帰還できるようにするとともに、入植者によるさらなる暴力から住民を保護し、家屋や村のインフラの再建を許可しなければならない。また、ザヌータの土地に建てられた無許可の違法な入植拠点を速やかに撤去すべきだ。
2023年10月27日から11月1日にかけて、ザヌータの住民全員が荷物をまとめて村から避難した。近隣のアウトポスト（イスラエル政府の正式な承認を受けずに入植者が設けた入植拠点）からの入植者による繰り返される暴力的な襲撃から逃れるために、19世紀以来先祖代々住み続けてきた村を離れざるを得なかったのだ。それから3年近くが経過した今も、住民たちは避難生活を余儀なくされ、何度も帰還を試みたにもかかわらず、自宅に戻れずにいる。
南ヘブロン丘陵に位置するザヌータには、避難前、約250人のパレスチナ人（うち約100人が子ども）が暮らしており、羊の放牧、乳製品生産、農業で生計を立てていた。しかし土地と密接に結びついた独自の暮らしは、イスラエルのアパルトヘイト体制と国家が後押しする入植者の暴力の下、数十年にわたり安全と安定を奪われてきた。2011年以降、村の住居に対して取り壊し命令が出され、2021年以降は、村を取り囲むように入植者によるアウトポストが設けられたことで、状況は深刻化した。英国と米国は、攻撃の主な拠点であるアウトポスト「メイタリム・ファーム」を建設した人物に対し、資産凍結や渡航禁止などの制裁措置を課し、アウトポストそのものにも制裁を発動したが、攻撃を阻止するには不十分で、むしろ攻撃は激しさを増した。
2023年10月7日以降、入植者による襲撃は激しさを増し、ほぼ毎日のように発生。学校のテントや教室などが放火され、自宅に侵入され、ライフルで子どもたちが殴打され、農地に下水を流されたりした。警察に助けを求めても、反応はなかった。恐怖から、住民は全員、近隣の村に身を寄せた。その後、ザヌータへの帰還を何度も試みたものの、そのたびに軍の後押しを受けた入植者たちによる暴力に直面し、大部分は現在もなお戻れずにいる。
2024年7月29日、イスラエル最高裁は、イスラエル警察と軍に対し、ザヌータ住民の安全な帰還の実現と、入植者による暴力からの保護を命じた。2025年2月3日、同裁判所は前年の判断をあらためて確認し、当局に対して住民の帰還に加え、不法侵入者の排除と避難後に破壊された建物の再建を認めるよう命じた。
最高裁による最初の判決から2年が経過したが、イスラエル当局は依然として命令を執行しておらず、ザヌータ村は永久に消滅する危機にひんしている。
占領国として、イスラエルには、占領下のパレスチナ地域で暮らすパレスチナ人の生命と生計手段を保護し、入植者による暴力を防止するとともに、パレスチナ人に対する犯罪の加害者を捜査・起訴する義務がある。東エルサレムを含む占領下のヨルダン川西岸地区におけるイスラエル人入植者の存在は国際法上違法であり、入植地やアウトポストは撤去されなければならない。とりわけ、アウトポストはイスラエルの国内法上でも違法である。

Lieutenant General Zamir,
I am writing to demand the immediate return of the forcibly displaced residents of Zanuta to their village in the South Hebron Hills of the occupied West Bank, as per your obligations under both international law and the orders of Israel’s Supreme Court.
Between 27 October and 1 November 2023, the entire community of Zanuta, home to 250 Palestinians, including 100 children, were forced to pack up their belongings and flee the village where their ancestors had lived since the 19th century, as a result of recurrent violent raids and attacks by Israeli settlers from a nearby illegal outpost. Nearly three years on, the community remains displaced and fragmented and unable to return to its homes, despite numerous attempts to go home.
On 29 July 2024, the Israeli Supreme Court ordered the Israeli police and the military to facilitate the safe return of Zanuta's residents and protect them from settler violence. On 3 February 2025, the Court reaffirmed this obligation, ordering the same authorities to facilitate the community's return, remove trespassers, and allow residents to rebuild structures that were destroyed since their displacement.
Two years from the first Supreme Court ruling, Israeli authorities are yet to enforce these orders, and the village of Zanuta risks permanent erasure.
As an occupying power, Israel has the obligations to protect the lives and livelihoods of the Palestinians in the Occupied Palestinian Territory (OPT), including those of Zanuta, and to prevent settler violence and investigate and prosecute those responsible for offences against them. The presence of Israeli settlers in the occupied West Bank, including East Jerusalem, is illegal under international law and as such Israeli settlements and outposts, which are also illegal under Israeli law, must be removed.
I therefore urge you to act swiftly to immediately ensure the safe return of the Palestinians of Zanuta to their lands, protect them from any form of violence by settlers, provide effective remedy and reparations for the harm caused by settlers, and the Israeli authorities’ failure to prevent attacks by settlers and to secure residents’ return to their homes, as ordered by the Supreme Court. I call on you to ensure that Palestinians from Zanuta are, allowed to rebuild their homes, livelihoods, and community infrastructure, including the village's elementary school, and that the illegal outposts established in its proximity, including Meitarim Farm are urgently dismantled.
