漫画家と作家が昨年5月、政府の新型コロナ対策を批判する漫画やコメントをフェイスブックに投稿して拘束され、その後、作家は亡くなり、漫画家は体が不自由になった。作家はムシュタク・アーメドさんで、漫画家はアーメド・カビール・キショアさん。作家のアーメドさんは、勾留中に受けたと思われる暴行が原因で、拘置所内で死亡した。その１週間後、同じく暴行を受けていたキショアさんは保釈されたが、片耳の聴力をなくしている。また、左の膝と足首の痛みで満足に歩けなくなっている。
反政府的な漫画を描いてオンライン上に投稿するのは、犯罪にはならない。市民的および政治的権利に関する国際規約（自由権規約）などの国際人権法には、「自由な言動が、とりわけ重要」とある。しかし、2人は、デジタルセキュリティ法違反の容疑で9カ月間も勾留され、拘束中に暴行を受けたという。保釈申請を少なくとも6回したが、いずれも却下された。
アーメドさんは2月25日、勾留中に亡くなった。その後、死亡に抗議するデモが起こった。死亡原因の究明と刑務当局の説明責任、キショアさんの釈放、デジタルセキュリティ法の撤廃などを求めていた。国連人権高等弁務官は、バングラデシュ政府に対し、アーメドさんの死亡について、公正で透明性ある捜査を速やかに行うよう求めている。
3月3日には、キショアさんが、裁判所から6カ月間の保釈を認められた。彼はインスリン依存型（1型）糖尿病患者であり、勾留中、リットル当たり18から30ミリモルの極めて高い血糖値に苦しんでいた。
アーメドさんは長期間拘束され暴行を受けたために亡くなり、キショアさんの体調は悪化した。国連の自由権規約人権委員会は、「その発言で人を逮捕、拘留、裁判、収監するのは、規約違反だ」との見解を出してる。市民的および政治的権利に関する国際規約（社会権規約）などの国際人権法には、「自由な言動が、とりわけ重要」とあり、バングラデシュはその締約国だ。表現の自由の権利を行使しただけで、亡くなるようなことがあってはならない。
キショアさんら10人は、表現の自由の権利を行使して、デジタルセキュリティ法違反の容疑で逮捕・起訴されている。有罪になれば、最高10年の刑を受ける。

- 表現の自由を行使して訴追されている全員の容疑を取り消し、即時無条件に釈放する。
- アーメドさんの死亡に対して迅速で公正で徹底した捜査を行い、加害者の責任を問う。
- デジタルセキュリティ法を、自由権規約を含む人権法に準拠した法律に改正する。

Honourable Prime Minister Sheikh Hasina,
I am gravely concerned about the allegations of torture of cartoonist Ahmed Kabir Kishore and writer Mushtaq Ahmed who had been held in pretrial detention for nine months since May 2020 for posting satirical cartoons and comments critical of your government on social media.
Mushtaq Ahmed died in prison on 25 February 2021. A week later, on 4 March, Ahmed Kabir Kishore was released on bail for six months only. The cartoonist told Amnesty International that they both were tortured while in custody of one or more state security agencies before their arrest was officially recorded on 5 May 2021.
In addition to no longer being able to hear on his right ear, Ahmed Kabir Kishore also has difficulty walking due to pain in his left knee and ankle which shows the urgent need of proper medical attention to him.
Charged under Bangladesh’s draconian Digital Security Act, Ahmed Kabir Kishore and nine others in the same case could face up to 10 years in prison solely for peacefully exercising their right to freedom of expression, if convicted.
Drawing cartoons and posting criticisms online aren’t crime. Under international human rights law including the International Covenant on Civil and Political Rights, to which Bangladesh is a state party, “the value placed upon uninhibited expression is particularly high”. No one should have to die solely for exercising their right to freedom of expression.
I urge your government to:
- Immediately and unconditionally drop all charges against Ahmed Kabir Kishore and all those accused or detained solely for peacefully exercising their right to freedom of expression;
- Promptly, thoroughly, impartially, independently and transparently investigate the death in prison of Mushtaq Ahmed, allegation of torture of Ahmed Kabir Kishore and bring the perpetrators to justice;
- Repeal the Digital Security Act unless it can be amended in line with international human rights law including the International Covenant on Civil and Political Rights, to which Bangladesh is a state party.
