インドネシアのパプア系市民の独立を求める活動家で西パプア全国委員会のスポークスマン、ビクター・イェイモさんが、人種差別に平和的に抗議して恣意的に逮捕され、反逆罪の容疑で起訴された。勾留中は、独居室に入れられ、家族や弁護人との面会も厳しく制限されている。当局は、イェイモさんを即時釈放するか、公正な裁判にかけるべきだ。

イェイモさんは一昨年、人種差別抗議の際にパプア系の人びとの独立を問う住民投票を呼び掛けて、陰謀、虚偽・不確かな情報を拡散し、暴動を引き落とし、また、国旗などへの不敬もあったとして反逆罪に問われた。

同じ反逆罪に問われていた「バリクパパン・セブン」と呼ばれる活動家7人と共に裁判にかけられることになっていたが、イェイモさんは、パプアニューギニアに逃げこんだため、指名手配され、裁判は先送りされた。昨年末、イェイモさんは首都に戻り、今年5月9日に再逮捕された。グループの7人の裁判では、検察側は17年を求刑したが、判決は11カ月だった。検察は求刑と判決に大差があったにもかかわらず、上訴しなかった。

イェイモさんの判決はこれからだ。他の容疑を加えられるおそれもある。パプア警察署長は、「捜査内容をすべて確認し、その報告にもとづいて対応する。犯罪者は、刑務所で老いていけばいい」と述べている。

インドネシア当局は、言論、結社、平和的集会の自由の権利を行使することの合法性に基づいて活動した独立派の政治活動家を多数起訴している。

アムネスティは、国や地域を問わずいかなる政治的立場も取らない。同時に、言論の自由の権利は、独立か他の政治的解決かなどの立場を問わず、保護されるべきだと考える。

Dear Sir,

I am writing to express my concern about Victor Yeimo who has been arrested for peaceful anti-racism protest. Mr Yeimo was accused of treason during the period of heightened tensions in West Papua over his protests in the 19 August-30 September 2019 uprisings. As you will be aware, the incident swept across 23 towns in West Papua, 17 cities in Indonesia, and 3 cities overseas. In the aftermath of the event, 122 West Papuans were prosecuted.

On 9 May 2021, the first evening of his detention, Mr Yeimo was moved from Papua province’s regional police detention centre in Jayapura to the Police’s Mobile Brigade Headquarters (Mako Brimob) in Abepura, without his lawyers being notified. He has been held in solitary confinement since, and access to his family and lawyer is more difficult than before. Mr Yeimo has a medical condition that requires him to get regular treatment.

Mr. Yeimo has been accused of violating Article 106 on treason of the Indonesian Criminal Code (KUHP) and Article 110 of the KUHP on treason with conspiracy. As an addition to the charge, the Papua Police Chief suggested that one of the reasons behind his arrest was his participation at the 40th Session of the United Nations (UN) Human Rights Council in March 2019. This indicates that there is a political motivation to arbitrarily detain Mr. Yeimo.

Therefore, I urge you to:

  • Immediately release Victor Yeimo and drop all charges against him, unless there is sufficient credible and admissible evidence that he has committed an internationally recognized offence and is granted a fair trial in line with international standards,
  • Ensure that he has regular, unrestricted access to his family and a lawyer of his choice in line with the right to a fair trial, and
  • Ensure that he is protected from torture and other cruel, inhuman or degrading treatment or punishment and has access to adequate medical care on request or as necessary.
