良心の囚人である公共資産保護委員会のメンバー8人は、ホンジュラス北部のヨロ市で 2年4カ月以上も公判前勾留状態に置かれている。8人が拘束された唯一の理由は、採鉱プロジェクトでグアピノル川が汚され地域住民の水源が失われるおそれがあるとして、計画に反対の声を上げたことだ。裁判は今年1月13日に再開された。当局は、不当に拘束する8人の起訴を取り下げ、即時無条件に釈放すべきだ。
アムネスティは、8人に対する刑事訴訟手続きや事件に関連するビデオなど入手可能なすべての証拠を調べ、さらに、目撃者やホンジュラスの人権団体から話を聞いた。その結果、きれいな水と安全な環境の権利を守る活動をしただけの理由で、8人が拘禁されていることは明らかだった。
ホンジュラス地質管理機関は、北部トコア市にある採掘会社ILPに、カルロスエスカレラス国立公園内で2つの採掘権を与えた。土地と環境を保護する団体で構成される公共資産保護委員会は、これに抗議して、2015年から採掘停止を求める運動をしてきた。
委員会は、地質管理機関、ホンジュラス森林保護研究所、環境省の3機関を相手取り、地域の水源である保護地域の開発を認めたのは、権限の濫用と環境犯罪だとして刑事告発した。審理が進まないため、同委員会は2018年8月、公道上に抗議のテントを張ったが、3カ月後の10月、当局に強制排除された。
裁判は、昨年12月１日に始まった。その後、弁護団による裁判官忌避の申し立てで一旦休廷になったが、申し立てが控訴裁判所に却下された後、今年1月13日に裁判は再開した。昨年8月に起こした、公判前勾留の6カ月延長に異議を申し立てた人身保護令状に関して最高裁が決定を下していない中での再開だった。

I’m writing to express my deepest concern for the life and integrity of prisoners of conscience José Daniel Márquez, Kelvin Alejandro Romero, José Abelino Cedillo, Porfirio Sorto Cedillo, Ewer Alexander Cedillo, Orbin Nahún Hernández, Arnol Javier Alemán and Jeremías Martínez Díaz, members of the Municipal Committee for the Defence of Common and Public Assets (CMDBCP in Spanish) and defenders of the Guapinol river in Northern Honduras, who have been wrongfully deprived of their liberty for more than 28 months.
After having reviewed all the evidence available, including the criminal proceedings against the Guapinol eight and videos related to the case, and spoken to witnesses as well as to the human rights community in Honduras, Amnesty International considers that they are being detained only because of their activities in defense of the right to clean water and a safe environment.
The trial of the Guapinol eight began on 1st December 2021 and resumed on 13 January 2022, after a court of appeals did not admit a recusal filed by the legal team of the eight defenders, and despite the Supreme Court having not yet decided on a writ of habeas corpus to challenge the extension to six more months of pre-trial detention in August 2021.
I urge you to drop the charges against the eight human rights defenders who continue to be unfairly imprisoned after more than two years, so that they are immediately and unconditionally released in compliance with the recommendations of the UN Working Group on Arbitrary Detention, in order to guarantee their right to life, health, liberty, freedom of expression and right to defend human rights.
