2021年9月19日、「#MeToo」運動の活動家の黄学琴（Huang Xueqin）さんと労働者の権利を求める王建兵（Wang Jiangbing）さんが逮捕された。2人は、市民社会が直面する問題を話し合う私的集会の開催と非暴力運動に関わる研修の受講などで当局に問題視された。2人はその後、国家権力転覆扇動罪に問われ、今年6月14日、黄さんは禁錮5年、王さんは禁錮3年6カ月の判決を言い渡され、それぞれ控訴した。情報によると、拘置されている2人はともに健康上の問題を抱えているにもかかわらず、治療を受けられないという。当局は、2人を即時無条件で釈放するべきだ。
ジャーナリストの黄さんは、性的暴行やハラスメントの被害者を支援する#MeToo運動にかかわってきた。王さんは、障がい者や職業病を患う労働者らを法的に支援してきた。2人とも「#MeToo」運動の支援者として国内で知られている。また、2人はオンラインでの人権教育も手掛け、中国政府が「機密事項」とみなす問題に関する批判的意見の投稿もしていた。
拘置中、2人は家族との面会を認められない一方で、2人の友人10数人が警察に呼び出され、家宅捜索を受け、電子機器を押収された。さらに、2人は拘置所で冷酷な扱いを受けているという。王さんの体調は悪くなるばかりで、特に心臓と胃腸の病気が深刻で、検査で僧帽弁閉鎖不全症、左心室異常、不整脈が見つかったという。取調べによる心身の負担で消化器系の病気が悪化し、頻繁に下痢を起こしている。しかし、何の治療も受けられず、刑務所に届けられた薬を受け取ることもできない。このような厳しい状況にあっても、王さんは気丈さを維持し、哲学書の差し入れを求めているという。
中国当局は、「国家権力の転覆」や「国家権力の転覆を扇動する」など、非常に曖昧な規定を持つ国家安全保障に関する罪を適用して、弁護士、学者、ジャーナリスト、活動家、NGO職員などを起訴している。
2022年、国連の「恣意的拘禁に関する作業部会」は、王さんが恣意的に拘禁されていると断定し、中国政府に対し「国家転覆罪」の廃止と国際基準に沿った新法の制定を求めた。一方、黄さんと王さんの拘置から2年が経つ2023年9月、アムネスティは他の団体と共同で声明を出した。

Dear Director Zhang Rui / Chief Procurator Zhang Jian,
I am writing to express my concern for #MeToo activist Huang Xueqin (黄雪琴) and labour activist Wang Jiangbing (王建兵). On 14 June 2024, Huang was sentenced to five years and Wang to three years and six months, for “inciting subversion of state power” (煽动颠覆国家政权). Both of them have formally filed appeals with the Guangdong High Court.
Huang and Wang were both detained in Guangzhou from 19 September 2021 and held incommunicado for more than five months. Huang was reported to be forced by the authorities to dismiss the lawyer of her choice and accept a state-appointed lawyer instead. Only after domestic and international pressure was she allowed to appoint her own lawyer again.
Furthermore, I am extremely concerned about their health. According to reliable sources, Wang has serious heart and gastrointestinal problems and has been unable to receive timely and appropriate examination and treatment, despite his repeated expressions of concern to the administration of the detention centre. Prior to their sentencing, Huang was also reported to be suffering from prolonged amenorrhoea and sudden weight loss, among other health problems.
Sentenced only for exercising their rights to freedom of expression and association, Sophia Huang Xueqin and Wang Jianbing should be released immediately. Therefore, I urge you to:
- Release Sophia Huang Xueqin and Wang Jianbing immediately and unconditionally;
- Pending their release, ensure that they have prompt access to adequate medical care, including a regular full body checkup and treatment by qualified medical professionals, and that they are not subjected to torture or other forms of ill-treatment;
- Stop harassing, arresting, and threatening other human rights defenders who peacefully exercise their right to freedom of association and other human rights.
