恣意的に勾留されているクルド系イラン人のソアダ・ケディルザデさんは6月20日、帝王切開による出産後、乳児とともに刑務所に戻され、その後、適切な産後のケアを受けられない事態が続いている。抱えている腎臓病と心臓病の治療も満足に受けられていない。また、昨年10月の逮捕以来、弁護士との連絡も認められていない。
妊娠6週間のケディルザデさんが逮捕されたのは、当局の捜査対象になっていた夫がイランを出国した翌日の昨年10月8日のことだった。それ以来、夫の出国に手を貸したという自白をさせたい係員から厳しい尋問を受けた。容疑否認のまま今年3月まで拘束され、その後、「治安騒乱を目論む団体」に所属した容疑で起訴された。「治安騒乱を目論む団体」とは、イラン・クルド民主党を指していることは明らかだったが、本人は、団体との一切の関係を否定している。初公判は8月24日に予定されている。
昨年12月には、刑務所の医師団が、ケディルザデさんを外部の専門医に診せる必要があるとの見解を示したが、検察当局は、この見解を受け入れなかった。長引く勾留と専門医による治療を認められないことに抗議して、ケディルザデさんは4月26日から12日間のハンストに入り、拘置所内での診察も拒否した。
ハンスト中、取り調べ時に受けた罵声や過酷な尋問の様子を語った音声がその後外部に持ち出され、公表された。音声には、「夫をイランに引き戻すために自分が人質に取られたようだ」との発言も入っていた。その後、刑務官からハンストをやめれば保釈されると言われハンストをやめたが、保釈は認められなかった。
6月初め、当局が要求した保釈金は約300億リアル（約9500万円）で本人や家族が調達できる金額ではなかった。また、刑務官が母子に十分な便宜を図っていないため、別の囚人が親子にもっと適したベッドを提供することになった。栄養価の高い食物も与えられず、刑務所外での乳児検診も認められていない。
イランでは、非拘禁者は当局の捜査対象になると多くの場合、令状もなく逮捕され、家族と連絡が取れないまま長期間、勾留される。 諜報省など治安機関に所属する捜査官が関わると、容疑者は弁護人に面会することもできなくなる。

Authorities are denying arbitrarily detained Iranian Kurdish woman So’ada Khadirzadeh, 32, postnatal and post-surgical care, as well as treatment for her serious kidney and heart conditions, and lower back pain in Urumieh prison, West Azerbaijan province. Throughout her pregnancy and while Covid-19 was rampant in prisons in Iran, prosecution authorities and Ministry of Intelligence agents repeatedly denied her access to the specialized health care she required. According to an informed source, authorities ignored medical advice for her to be under close medical observation during her last month of pregnancy. On 20 June 2022, So’ada Khadirzadeh was transferred from Urumieh prison to hospital, where Ministry of Intelligence agents kept her hands and feet shackled to the bed while she was in active labour, in violation to the absolute prohibition of torture and other ill-treatment. The shackles were removed after medical staff protested. Her child was born following a caesarean operation, but authorities transferred her and her newborn back to Urumieh prison on the same day, against medical advice.
In a leaked audio message recorded inside prison in late April 2022, So’ada Khadirzadeh stated that following her 14 October 2021 arbitrary arrest by Ministry of Intelligence agents in Piranshahr, West Azerbaijan province, she was held for 25 days in a Ministry of Intelligence detention centre. There, agents subjected her to intense interrogations, which included verbal abuse of a sexual nature, to compel her to “confess” to helping her husband, who left Iran a day prior to her arrest and who they said was wanted. She was then transferred to Urumieh prison, where she has been denied access to a lawyer. She was held without charge until prosecution officials indicted her around March 2022 for “membership of a group with the purpose of disrupting national security” in apparent reference to the Kurdish Democratic Party of Iran and being accessory to murder, all of which So’ada Khadirzadeh denies. She was arrested in the days after the reported killing of a man in Piranshahr identified by human rights activists abroad as a Ministry of Intelligence agent. A first court hearing before a criminal court is scheduled for 24 August 2022.
I urge you to release So’ada Khadirzadeh, whose detention is arbitrary on the basis of the non-observance of international norms relating to the right to a fair trial and as it stems from her family affiliation, and who as a nursing mother with pre-existing health conditions is at heightened risk of severe illness and health complications. Pending her release, I urge you to immediately provide her and her newborn with the medical care they require, including at facility outside of prison, as well as access to her lawyer and visits with her family. I also urge you to ensure that mother and newborn are provided with nutritious food and formula as well as a healthy environment.
