バローチ人女性マハル・バローチさん(28歳)は、自宅に不当な強制捜索を受けた後、2月18日に警察のテロ対策課に逮捕された。幼少の娘2人は母親から引き離された上、一晩拘束された。マハルさんは、起訴されないまま警察で勾留され続けている。裁判所に4回も呼び出され、そのたびに勾留延長が認められた。警察当局は、国際人権法に基づいて直ちにマハル・バローチさんを釈放するか、妥当な容疑で起訴すべきだ。
マハル・バローチさんは2016年に夫が亡くなって以来、シングルマザーとして8歳と5歳の娘を育ててきた。義理の姉は、パキスタン南西部バローチスタン州の人権侵害を調査・記録するバローチ人権機構の創設者である。マハルさん自身も親族の活動に賛同して多数の抗議行動に参加してきた。とりわけ頻発する強制失踪に関わる活動には熱心だった。同地で学生、活動家、ジャーナリスト、人権活動家などの強制失踪が絶え間なく続いている事態については、アムネスティも調査し記録したことがあった。
2月17日の午後11時、マハル・バローチさんの住む家は治安当局の強制捜索を受けた。当局から捜索令状を提示されることはなかった。その後、マハルさんと母親、姪、娘らは、州都クエッタの警察のテロ対策課に連行されたが、マハルさんだけ別室に引き離された。姪がバローチスタン人権評議会に話したところによると、勾留中に、マハルさんの悲鳴が聞こえたという。
バローチスタン人権評議会によると、2月18日にマハルさん以外の女性たちは釈放された。一方、マハルさんは起訴されないまま4回もテロ対策裁判所に呼び出されたあげく、当局の主張通り半月以上の勾留を認める裁判所の判断を受けた。
バローチスタン州での人権危機は続いている。武装組織の一員やテロリストとみなされた反体制活動家らが、治安部隊による強制失踪や超法規的処刑を受けたという情報が相次いでいる。アムネスティは、テロ攻撃に加わったと疑われている人たちが有罪か無罪かを判断する立場にはない。しかし、国内外の法律によって保証された人権は、誰もが全面的に享受できなければならない。アムネスティは無差別攻撃や武装勢力による市民への攻撃を非難する。またアムネスティは、テロをはじめとする暴力犯罪の防止や犯罪者の処罰の責務が当局にあることは確かだと考える。しかし、パキスタン政府は、テロ活動などへの関与が疑われる人物を強制失踪させることで重大な人権侵害を犯しており、また、こうした人物を起訴し公正な裁判にかける義務を怠ってきた。

I write to you out of extreme concern for Mahal Baloch, a 28-year-old Baloch woman has been arbitrarily detained by the Counter Terrorism Department (CTD) of the police in Quetta, Balochistan. Mahal has been detained for over one month without charge. This is a violation of Mahal’s fair trial rights including the right to be free from arbitrary arrest and to be promptly informed of any charges against her. Mahal’s prolonged detention is a violation of international fair trial standards and Pakistan’s legal international human rights obligations including under the International Covenant on Civil and Political Rights.
On 17 February 2023, Mahal’s home was unlawfully raided at 11pm. A total of six female family members, including Mahal, Mahal’s two daughters (age 8 & 5), her niece (age 12), Mahal’s sister-in-law and Mahal’s mother were detained overnight at the CTD office. On 18 March, Mahal was brought before the Anti-Terrorism court where the court permitted her to be physically remanded for 7 days. Mahal’s detention contravenes fair trial safeguards enshrined in international human rights law.
Mahal has been produced before courts four times, with the CTD requesting her remand custody be extended, without formally charging her. In light of the circumstances of Mahal’s arrest, her detention is arbitrary and unlawful.
As such, I urge you to:
- Immediately release Mahal Baloch, unless there is sufficient, credible and admissible evidence that she has committed an internationally recognized offence;
- Pending her release or charge, authorities must ensure her fair trial rights are guaranteed, that she has the right to challenge the lawfulness of her detention and has access to bail hearings;
