2021年7月、キューバ全土で反政府運動が広がる中、「キューバ愛国同盟」の代表ホセ・ダニエル・フェレール・ガルシアさんが逮捕された。家族の話では、ガルシアさんは8月14日から独居房に入れられ、今年3月17日以降は、拘置場所を知らされなくなったという。体調を崩しているおそれがあり、家族は気がかりな日々を送る。ガルシアさんは良心の囚人であり、即時無条件に釈放されるべきだ。
ガルシアさんは人権活動家であり、反政府グループの「キューバ愛国同盟」の代表を務めている。2021年7月、デモに参加しようと自宅を出た後に拘束された。拘置中、家族との面会や連絡は認められなかった。
その後、ガルシアさんは「公共秩序の騒乱」の罪で起訴された。しかし、裁判は開かれなかった。2020年には、違法行為に関与したとして自宅軟禁4年半の有罪判決を受けていた。アムネスティが入手した資料によると、ガルシアさんは2021年8月、サンティアゴ・デ・クーバ州裁判所に「公共秩序の騒乱」の罪で有罪を言い渡され、自宅軟禁に代えて刑務所での服役を言い渡された。
昨年6月4日、サンティアゴ州裁判所は、家族が提出した人身保護の申立てを棄却した。翌月7日、国連の強制失踪委員会は、外部世界とのコミュニケーションに関する詳細情報を委員会に提供することを求める書簡をキューバに送ったことをNGOの囚人擁護者団体に伝えた。
ガルシアさんは、「長期間の収監で体調を崩した」と訴えた。今年3月の家族の話では、彼は耳鳴り、皮膚の炎症、歯痛、視力低下などに悩まされている。また、適切な歯の治療や投薬を受けていないという。

Dear President,
I am writing to demand information regarding José Daniel Ferrer García, the leader of the Patriotic Union of Cuba, who, according to his family, has been held incommunicado for more than eighty-two days, without access to the outside world. The latest information received by his family in March 2023 indicated that he is suffering from serious health problems and is not receiving adequate medical attention.
The last time he was able to communicate with his family by phone was on March 6, and the last conjugal visit, according to his family, took place on March 14. Additionally, on March 17, José Daniel received a visit from the Archbishop of Santiago de Cuba. Since then, family visits, conjugal visits, and phone calls have been denied. Prior to that, his family had already informed Amnesty International that he has been held in a separate cell from other prisoners since August 14, 2021.
Detention without access to the outside world—being held incommunicado—facilitates torture andother ill-treatment and forced disappearances. In certain circumstances, it can itself constitute a form of torture or cruel, inhuman, or degrading treatment. Similarly, solitary confinement should only be used in exceptional circumstances, and if sustained for prolonged periods, it can also violate the prohibition of torture and other ill-treatment.
On May 18, 2023, Amnesty International sent you an open letter informing you of this situation, José Daniel's deteriorating health, and demanding his immediate release. To date, no response to this letter has been received.
José Daniel Ferrer García, who was detained on July 11, 2021—before he could join the massive protests that took place across the island—is a prisoner of conscience, imprisoned solely for peacefully exercising his human rights.
I urge you to release José Daniel immediately and unconditionally and, pending his release, end his isolation and allow his family to communicate with him without delay.
