野党指導者 大統領批判で実刑2年

カイド・サイード大統領の政敵アベル・ムーシさんが、次期大統領選に立候補する意向を示した数日後の10月3日、治安当局に拘束された。ムーシさんは、選挙プロセスに不透明なところがあるとして、間近に迫る地方選挙に関する大統領令に抗議する請願を出そうとしていた。彼女は治安部隊に拘束され、秘密の場所に連行された。2日後の10月5日、治安関連の申し立てについて当局の尋問を受け、そのまま公判前勾留されてしまった。ムーシさんは、平和的な表現・結社・集会の自由の権利を行使しただけであり、直ちに釈放され、すべての訴追は取り消されるべきだ。

弁護士のムーシさん（48歳）は自由デストゥリアン党（PDL）の党首を務め、サイード大統領の政敵でもある。2019年から2021年にかけては国会議員も務めた。弁護人によれば、拘束されたムーシさんの健康状態は悪化しており、11月28日に始めたハンストで体調はさらに悪化しているはずだという。

10月5日、ムーシさんは「政府の形を変える」、「暴力の煽動」などの容疑で取り調べを受けた。表現・集会・結社の自由の権利を平和的に行使しただけであるが、刑法第72条に基づき死刑を受けるおそれもある。

2021年7月21日、サイード大統領は2014年憲法が大統領に与えているとして非常事態を宣言した。2023年2月以降、野党議員数人が命を狙われるなど、チュニジアの人権状況は厳しい局面を迎えている。当局は、拘束した74人以上の野党関係者の取り調べを始めた。そのうち少なくとも44人が人権活動で罪に問われている。

On 5 August 2024, The Tunis Court of First Instance sentenced Abir Moussi to two years in prison based on public statements she had made in November 2022 and January 2023 criticizing the legislative electoral process under Decree-Law 54 following a complaint filed by the High Independent Authority for Elections (ISIE). Abir Moussi is also facing a separate investigation for exercising her rights to freedom of peaceful assembly and expression based on protests that she led or statements that she made.

Criticism of the authorities is protected speech under Article 19 of the International Covenant on Civil and Political Rights and Article 9 of the African Charter on Human and Peoples’ Rights to which Tunisia is a state party.

I urge you to immediately release Abir Moussi and drop all charges against her as they stem solely from her peaceful political activism. Pending her release, she must be granted regular access to her family, lawyers and adequate healthcare, and held in conditions that comply with international standards for the treatment of prisoners.

• OPPOSITION FIGURE HANDED TWO YEAR SENTENCE

地方選挙の手続きをめぐる批判で独立選挙管理機関（ISIE）に告発されていた弁護士のアベル・ムーシさんが8月5日、チュニスの一審裁判所で禁錮2年の実刑判決を言い渡された。ムーシさんは、「政治形態の変更の企図」「暴力の扇動」「無秩序を誘発する目的での攻撃」などの容疑で、2023年10月から恣意的に勾留されてきた。ムーシさんは、平和的な表現・結社・集会の自由の権利を行使しただけであり、無罪を言い渡されるべきだ。

ムーシさんは自由デストゥリアン党（PDL）の党首を務め、サイード大統領の政敵でもある。2019年から2021年にかけては国会議員も務めた。

ムーシさんは、昨年10月3日に治安部隊に拘束され、10月5日に治安関連の申し立てについて当局の尋問を受け、そのまま公判前勾留されてしまった。今年1月30日、捜査判事はいくつかの訴追を取り下げたが、検察は判事の決定に対し控訴し、訴追は再審査されている。

2022年12月から翌年3月にかけて、「ISIEが選挙を操作した」というムーシさんの批判発言を根拠に、ISIEはムーシさんへの4件の告訴をチュニスの検察官に提出した。今年7月、捜査判事はISIEの告訴について取り調べを行った。ムーシさんは公判前勾留され、「虚偽のニュースや声明、噂や偽造文書を意図的に通信ネットワークやシステムを通じて作成、宣伝、発信、準備した」として、裁判にかけられた。今年8月、ムーシさんは禁錮2年の刑を言い渡された。ムーシさんの公正な裁判と表現の自由の権利が大きく侵害された。

ムーシさんは、2022年5月に国際イスラム学者連盟による刑事告訴も受けている。この告訴は、チュニスにある同連盟の事務所前で行われた抗議活動が、同連盟に対する財産損害、窃盗、名誉毀損、虚偽情報の拡散、公的威嚇などにあたるとされた。国際人権法によれば、名誉毀損は刑事ではなく民事事件として処理されるべきであり、実刑の対象にはならない。公務員が名誉毀損の救済を求める場合、それは刑事裁判ではなく民事裁判で行われるべきだとしている。

2021年にサイード大統領が緊急措置権限を行使して以降、チュニジアでは反対派への弾圧が強まり、表現の自由や 平和的集会の自由が脅かされている。
