アフマド・ファヒム・アジミさんとセッディクッラー・アフガンさんは、女子の教育の権利を主張する非営利団体「フェクレ・ペタル」で活動してきた。団体はタリバンによる女子教育の禁止に強く反発してきたことで知られている。2人は2023年10月、タリバン情報総局に恣意的に逮捕され、タリバンに刃向かう行動を取ったとして告発された。取り調べの名目で情報総局に72日間拘束され、12月27日の裁判後、刑務施設に拘禁された。この逮捕と勾留は国際人権法違反であり、当局は2人を即時無条件に釈放すべきだ。
アジミさんとアフガンさんは、ヘラート州の女性によるロボット開発チームに関わってきた。開発チームは、科学技術分野における女性の参加を後押しし、女子教育での学びとその後のキャリアを後押しする活動をしてきた。この2年間、「フェクレ・ペタル」も女子学生のための英語やフランス語などの外国語の習得や、ロボット制作やプログラミングなど技術面での訓練を支援してきた。
10月17日、タリバン情報総局はフェクレ・ペタルの事務所を家宅捜査し、事務所にいたアジミさんとアフガンさんを連行した。その際、パソコン、教員や学生に関わる資料、パスポートなどを押収した。家族が2人の拘束されている場所を突き止めたのは27日後だった。
2人は、ロボット開発チームの女子の出国支援や一般女性の抗議活動への参加の働きかけなどをした容疑で72日間勾留された。拘束中は、睡眠妨害や独居拘禁などの拷問や虐待を受けた。弁護人との接触や治療も認められなかった。
12月27日、2人はタリバン法廷に出廷したが、尋問の内容が不十分だとの裁判所の判断で刑務所に戻された。2人は尋問内容と裁判所の判断に抗議したため、「タリバンに敵対する活動をしている」とカメラの前で自白するよう迫られたが、拒否した。
裁判所によれば、2人は控訴審で弁護人を付けることを認められるということだったが、弁護人がタリバンの脅迫や拘束を受けるおそれは拭えない。一方、弁護人不在なら2人が受けた拷問や裁判の不当性の立証が難しくなる。
アフガニスタンに関する国連アフガニスタン支援ミッション (UNAMA)は2人の恣意的な逮捕を非難し、家族との面会や弁護人選任の自由、公正な裁判の実施などを求め、人権活動家に関する国連特別報告者は2人の即時釈放を訴えている。

Dear Mr. Abdul Haq Wasiq,
I am writing to express my concern about the arbitrary arrest and detention of education activists Ahmad Fahim Azimi and Sediqullah Afghan, who work with Fekre Behtar, an organization which is recognized for its work with the Afghan girls’ robotics team. The organization is also a vocal critic of the education restrictions the Taliban imposes on women and girls.
On 17 October 2023, Ahmad Fahim Azimi and Seddiqullah Afghan were arrested by members of the Taliban’s General Directorate of Intelligence (GDI) District 40 at their office in Karta Char, Kabul. Both activists were kept by the GDI District 40 for 72 days for interrogation. They were falsely accused of assisting girls from the national robotic team to leave the country, inciting women protestors, and organizing protests. Both the activists and their families have refuted these allegations. On 27 December 2023, the two activists appeared in a Taliban court in Kabul. The Taliban judge deemed the interrogation findings inconclusive and ordered their transfer to Pul-e-Charkhi prison. Deprived of a fair trial, Ahmad Fahim Azimi and Seddiqullah Afghan challenged the judgement. In retaliation, the authorities subjected the two activists to torture and other ill-treatment, including sleep deprivation and solitary confinement, as the Taliban de-facto authorities wanted them to confess they were working against them.
Ahmad Fahim Azimi and Seddiqullah Afghan’s situation is a clear violation of the rights to freedom of expression and peaceful assembly and fair trial rights guaranteed under the International Covenant on Civil and Political Rights, to which Afghanistan is a state party.
I therefore urge you to:
- Immediately and unconditionally release Ahmad Fahim Azimi and Seddiqullah Afghan.
- Uphold the obligations imposed under the Convention against Discrimination in Education by immediately allowing girls of all ages to attend school and receive education on an equal basis with boys.
- Stop the practices of abductions, arbitrary detention, and torture and other ill-treatment of people working to defend human rights including those peacefully campaigning for the right to education.
