3月6日、タイの移民警察局はベトナム人活動家のレ・チ・タンさんを逮捕し、バンコクのスアン・プル入国管理収容センターに収容した。レ・チ・タンさんは元警察官であり、ソーシャルメディアを通じてベトナム公安部門内の汚職や不正行為を暴露していた。2022年には、社会・政治問題について意見を表明したことで、でっち上げの罪に問われ、合計5年の禁錮刑を受けている。出所後はタイに渡り、就労許可を取得した。入国は合法的なものだったにもかかわらず、タイ当局は彼を逮捕。ベトナム当局がパスポートを無効にしたため、就労許可も無効になったと主張しているが、逮捕されるまでレ・チ・タンさんはパスポートが失効したことを知らされていなかった。もしベトナムに強制送還されれば、拷問や虐待などの深刻な人権侵害を受ける可能性が高い。レ・チ・タンさんは直ちに、無条件で釈放されなければならない。
レ・チ・タンさんの拘束は、タイとベトナム当局による国境を越えた弾圧の一環だ。パスポートが恣意的に取り消されたことは憂慮すべき事態であり、ベトナム当局が亡命中の活動家に帰国を強要し、迫害を加えようとしていることを示している。
2021年年4月、彼はホーチミン市内にある省直轄市トゥドゥックで交通警察に「公務執行妨害」の容疑で逮捕され、翌年1月に2年の実刑判決を受けた。同年6月には、フェイスブックで当局を批判したことが刑法の「民主的自由を悪用して国家と個人の正当な権利・利益を侵害した」罪にあたると、さらに3年の刑を言い渡された。
公判でレ・チ・タンさんは、勾留中に殴られたり、手足を縛られて吊るされるなど、自白を得ようとする警察から7日間にわたり拷問を受けたと証言。2022年11月、国連の専門家はベトナム政府に対し書簡を送り、この拷問の訴えについて懸念を表明した。以前のアムネスティの調査でも、ベトナムでは人権活動家など信念や信条などに基づいて行動したことで投獄された人びとが、拘禁中に拷問や虐待にさらされる危険があるという実態が、明らかになっている。
国連の専門家はまた、タイの収容施設に拘束されているベトナム中央高原の先住少数民族モンタニャールやモン族の難民をベトナム当局者が訪問し、「自発的」なベトナムへの帰国を強要するパターンを記録している。こうした事例は、ベトナム当局による威嚇や強制に対して無防備な状態のベトナム難民を効果的に保護する能力や意思が、タイにはあるのかという、深刻な疑念を浮き彫りにする。
市民団体や国連の専門家は、反体制派を標的とするタイとベトナム当局間の協力が拡大していることについて繰り返し警告してきた。ベトナムではタイ人の活動家が強制失踪に遭い、タイではベトナム人ブロガーやジャーナリストが強制失踪に遭っている。2026年2月には、タイ当局がモンタニャールの人権活動家をベトナムに強制送還しており、国境を越えた弾圧がひどくなっていることが伺える。
深刻な人権侵害を受けるおそれのある国への送還を禁ずる「ノン・ルフールマン原則」は、すべての国が守るべき国際慣習法だ。タイ当局はレ・チ・タンさんを強制送還してはならない。

Dear Prime Minister
I am writing to express my grave concern for Vietnamese anti-corruption activist Le Chi Thanh who was arrested by immigration police on 6 March and is currently detained at Bangkok’s Suan Phlu Immigration Detention Centre (IDC). He is at risk of imminent deportation to Viet Nam.
Le Chi Thanh is a former police officer who used social media to expose corruption and misconduct within Viet Nam’s public security sector. In 2021 and 2022, he was sentenced to a total of five years in prison on trumped up charges for peacefully expressing his views on social and political issues. Following his release, he lawfully entered Thailand and obtained a work permit. Thai authorities claim that Le Chi Thanh’s work permit became invalid following the Vietnamese authorities’ cancellation of his passport. Le Chi Thanh was never informed of this cancellation prior to his arrest. At present, he is a refugee in Thailand.
I am concerned about reports that Thai authorities allowed personnel from the Vietnamese Embassy to visit Thanh at the detention center. This visit appears to align with the existing pattern observed in many cases where Vietnamese officers were able to visit Vietnamese asylum seekers and refugees held in Thai detention facilitites to pressure them into ‘voluntarily’ returning to Viet Nam.
Further, I am deeply disturbed by Le Chi Thanh’s report that he was tortured by police officers during pre-trial detention in Viet Nam in 2021, including being beaten and hung by his arms and legs, after he was arrested for exercising his right to freedom of expression. This information points to a real and serious risk of further human rights violations, including torture and other ill-treatment, that Le Chi Thanh is likely to face if returned to Viet Nam.
Prime Minister, I urge you to:
- Refrain from forcibly returning Le Chi Thanh to Viet Nam in line with Thailand’s obligation under the absolute international legal obligations of non-refoulement, the UN Convention Against Torture, and the domestic law on torture and enforced disappearance;
- Immediately release Le Chi Thanh and ensure that he and other asylum seekers have access to a full, effective, and fair assessment of their asylum claims and resettlement;
- Refrain from permitting visits by Vietnamese officials to Vietnamese detainees with ongoing asylum procedures without their consent and not at their request which could potentially serve as threats, intimidation and coercion of the refugees and asylum seekers to return to Viet Nam against their will;
- Pending his release, ensure Le Chi Thanh is treated in full accordance with the UN Standard Minimum Rules for the Treatment of Prisoners (the Nelson Mandela Rules) and is protected from torture and other ill-treatment and provided access to legal assistance and medical care if needed.
