日本：生命の危機にあるムスタファ・カリルさんの強制送還を直ちに停止せよ

茨城県牛久市にある東日本入国管理センターにおいて、通算12年半にわたり収容され、深刻な健康状態にあるパキスタン、カシミール出身のムスタファ・カリルさん（62歳）に対し、2025年12月17日付で強制送還を行うとの通知がわずか一週間前の12月10日に一方的に出されました。単独での歩行も困難で、医師から航空機搭乗不可能と判断されているにもかかわらずです。

アムネスティ・インターナショナル日本（以下、アムネスティ日本）は、現在の健康状態が著しく悪化しているカリルさんを強制送還することは、国際人権規約（自由権規約）第6条が保障する生命権、ならびに迫害や生命の危険がある場所に難民・庇護希望者を送還することを禁じたノン・ルフールマン原則に反する、極めて深刻な人権侵害であると考え強い懸念を表明します。

また、入管当局がカリルさん本人に対し、最新の医療情報、とりわけ担当職員が「問題が認められる」としたMRIの検査結果を1カ月以上にわたり開示していないことは、収容者の知る権利および適切な医療を受ける権利を侵害するものです。当該検査結果を直ちに本人に開示するとともに、独立した第三者専門医による速やかな診察が必要です。

さらに、外務省の海外安全情報によれば、カリルさんの出身地であるアザド・カシミール地域（領有権が争われているカシミール地方でパキスタンが実効支配する地域）は、レベル4（退避勧告）が発出されており、極めて危険な状況にあります。重篤な病状にあり、早急な医療的対応が不可欠な人物を、支援者や住居のあてもなく、深刻な安全リスクが存在する地域へ送還することは、人権および人道の観点から決して許されません。

日本政府に対し、アムネスティ日本は、以下の措置を直ちに講じるよう強く要請します。

1. 12月17日のムスタファ・カリルさんに対する強制送還を直ちに停止すること
2. 人道的配慮に基づき、カリルさんに在留特別許可を付与し、必要な医療を保障すること
3. 収容施設における医療情報を直ちに開示し、第三者専門医による診察を認めること
4. 国際人権基準に合致するよう、長期収容慣行を廃止し、難民申請者に対する人権保障を強化すること

Immediate Halt to the Forced Repatriation of Mr. Mustafa Khalil

The East Japan Immigration Centre in Ushiku City, Ibaraki Prefecture, has unilaterally issued a notification of forced repatriation, scheduled for December 17, 2025, to Mr. Mustafa Khalil (62), a Pakistani national from Kashmir who has been detained for a cumulative total of 12 and a half years and whose health is in severe decline. It was issued on December 10, only a week before the departure day. This is despite the fact that he is barely able to walk unassisted and has been deemed unfit for air travel by a physician.

Amnesty International Japan (hereafter, Amnesty Japan) expresses its strong concern that the forced repatriation of Mr. Khalil in his current, severely deteriorated health state constitutes an extremely grave violation of human rights, contravening the right to life guaranteed by Article 6 of the International Covenant on Civil and Political Rights (ICCPR), as well as the principle of non-refoulement, and expresses its strong concern.

Furthermore, the failure of immigration authorities for over one month to disclose his latest medical information, particularly the results of his MRI scan, which an accompanying officer admitted contained "problems," constitutes a violation of the detainee's right to know and right to receive appropriate medical care. The immediate disclosure of these test results to Mr. Khalil and swift access to an independent, specialized third-party physician are urgently required.

According to the Ministry of Foreign Affairs' Overseas Safety Information, the Azad Kashmir region (near the Line of Control with India), Mr. Khalil's place of origin, is currently under Level 4 (Evacuation Advisory), indicating an extremely dangerous situation. The forced repatriation of an individual with a severe medical condition who requires immediate treatment, with no support network or place to live, to an area facing serious security risks, is entirely unacceptable from the perspective of human rights and humanitarian principles.

Amnesty Japan urgently calls on the Government of Japan to take the following measures with no delay:

1. Immediately halt the forced repatriation of Mr. Mustafa Khalil scheduled for December 17.
2. Grant Mr. Khalil special permission for residence (Zairyū Tokubetsu Kyoka) on humanitarian grounds and ensure that he receives the necessary medical care.
3. Immediately disclose all medical information regarding his detention and authorize an examination by an independent, specialized third-party physician.
4. Abolish the practice of prolonged detention and strengthen human rights guarantees for asylum seekers, in line with international human rights standards.
